MRP – Maximum Retail Price

What is MRP pricing

MRP pricing is a consumer protection measure, aimed at preventing retailers from overcharging for products. It ensures that consumers are not exploited by retailers who may charge exorbitant prices for products which are deemed essential or in high demand.

How is MRP calculated and determined?

The MRP is generally determined by the manufacturer and is based on various factors such as manufacturing costs, distribution costs, and taxes. The MRP is also influenced by market forces such as demand and supply, competition, and changes in government regulations.

History and evolution of MRP

This MRP price stops retailers from charging more than the MRP from customers. However, there are still numerous cases where a product is sold for more than its MRP. For instance, in tourist destinations, particularly in hill areas where products are harder to come by, shopkeepers often charge more than the MRP. Following the 1997 change to the Standards of Weights and Measures Act, the MRP was adopted in India in 1990.

Criticisms of MRP

The implementation of MRP came under scrutiny due to its contrast with the free market system, where manufacturers determine the profit margins of retailers. One of the concerns with MRP is its susceptibility to manipulation, such as the arbitrary inclusion of cooling charges for cold drinks.

Manufacturers may set the MRP at inflated prices, often up to ten times higher than the expected sales price. Another disadvantage of MRP is its impact on rural areas, where retailers cannot charge more than the MRP, making it difficult to compensate for higher transportation costs.

Consequently, retailers tend to avoid stocking most items, leading to limited product variety and reduced access to goods for people residing in rural areas.

MRP is subject to the Legal Metrology Rules, PCR, 2011, which mandates that all packaged commodities must be labelled with a declaration and the MRP. The Pre-Packed Commodities rules were amended in 2011, which also require sellers on e-commerce platforms to display additional information, such as the manufacturer’s name and address, packer and importer details, net content, MRP, customer care number, and more.

The PCR also applies to medical devices like valves, syringes, thermometers, etc., where the MRP and declaration must be stated. Additionally, products must not have more than one MRP, and the font size of the MRP and other information like ‘best before date’ must be sufficiently large to enable easy reading for consumers.

Consumer Protection and GST Rules

In addition to the Legal Metrology Rules, the Consumer Goods Act of 2006 also prohibits charging consumers more than the MRP. However, with the introduction of GST, retailers began selling products above the MRP, citing that the printed price did not include taxes.

To address this issue, new rules have been implemented, which require a minimum of two newspaper advertisements if the price of a product increases post-GST implementation. Products whose prices decrease post-GST implementation do not require newspaper advertisements. If a seller charges more than the MRP under the pretext of GST, consumers can lodge a complaint against them with the anti-profiteering commissions.
